Terms & Conditions

These Terms and Conditions (“Terms”) apply to all bookings, visits, and stays at The Lamplighter Dining & Rooms. They form a legal agreement between you and us, so please read them carefully before making a booking. By making a booking, you confirm that you have read, understood, and agree to these Terms on behalf of yourself and all members of your party.

1. About us

“We”, “us”, and “our” refer to The Lamplighter Dining-Rooms Limited, 09826796, trading as The Lamplighter Dining & Rooms, with registered office at First Floor East Old Bridge Mills, Stramongate, Kendal, Cumbria, LA9 4UB and trading address at High Street, Windermere, Cumbria, LA23 1AF. “You” and “your” refer to the person making the booking and, where relevant, all members of the booking party.

2. Bookings

2.1 Room bookings

A booking for accommodation is confirmed only once we have issued a written booking confirmation by email and any required deposit or pre-authorisation has been received. Until that point, no contract exists between us.

It is your responsibility to check the details of the booking confirmation and to notify us promptly of any errors. Bookings are personal to you and may not be transferred to a third party without our written consent.

2.2 Dining bookings

A reservation for dining is confirmed once you receive a confirmation by email or message from us or our reservation platform. We may require a credit or debit card to secure the booking, in line with section 5 below.

2.3 Group bookings

Bookings for parties of 8 or more, exclusive private hire, and bookings during peak periods may be subject to additional terms, including a non-refundable deposit, set menu, and minimum spend. We will confirm any such terms in writing before the booking is finalised.

2.4 Accuracy of information

We make every reasonable effort to ensure that information about our menus, rooms, prices, and facilities is accurate. Occasionally, errors may occur and details may change without notice. We reserve the right to correct any errors and update any information at any time.

3. Prices

All prices include VAT at the prevailing rate where applicable. Room rates are quoted per room per night unless otherwise stated, and may include or exclude breakfast as set out at the time of booking. Dining prices are as shown on the menu in force on the date of your visit.

We reserve the right to change our prices at any time, but changes will not affect bookings already confirmed.

4. Deposits and payment for accommodation

Unless otherwise agreed in writing, a deposit is required at the time of booking and is non-refundable except in the circumstances set out in section 6.

The balance is payable on arrival or on departure, as agreed. We accept the following methods of payment: Visa, Mastercard, American Express, debit cards and cash. We may pre-authorise your card for the full balance at any time before or during your stay.

Failure to pay any sum when due may result in the cancellation of your booking, denial of access, or restrictions on services until payment is made.

5. Card details for dining bookings

We may require valid credit or debit card details to secure dining reservations, particularly for larger parties or peak times. Cards will not be charged at the time of booking unless agreed in advance, but you authorise us to charge a no-show or late cancellation fee in line with section 7.

6. Cancellation and amendments by you – accommodation

To cancel or amend a room booking, please contact us as soon as possible by telephone or email.

Terms may apply to non-refundable rates, advance purchase rates, packages, events, group bookings, and bookings made through third party platforms. The terms applicable to your booking will be confirmed at the time of booking.

Amendments to bookings (such as changes of dates, room type, or party size) are subject to availability and may incur a rate change.

7. Cancellation – dining

We ask that you give us as much notice as possible if you need to cancel or amend a dining reservation.

For larger parties, special events, and reservations covered by a deposit or pre-authorisation the specific cancellation policy will be confirmed at the time of booking.

8. Cancellation by us

In rare circumstances, we may need to cancel or amend a booking, for example due to circumstances beyond our reasonable control (see section 16), unforeseen maintenance, or operational reasons. Where we do so, we will:

  • Notify you as soon as possible.
  • Where reasonably possible, offer an alternative date, room, or table.
  • Refund any sums you have paid that we cannot fulfil.

Our liability in such circumstances is limited as set out in section 15.

9. Arrival and departure

Earlier check-in or later check-out may be available on request and at our discretion, and may incur an additional charge.

Late arrivals should let us know in advance. We may treat a guest as a no-show if no contact is made by 11.00 pm on the day of arrival, and we reserve the right to release the room and apply our cancellation policy.

10. Your stay

You agree, on behalf of yourself and your party, to:

  • Treat the property, fixtures, fittings, and contents with reasonable care.
  • Comply with our reasonable requests and any house rules in force at the time.
  • Not exceed the maximum occupancy stated for your room.
  • Not bring any animals onto the premises, except registered assistance dogs or pets we have agreed in writing in advance.
  • Not smoke, vape, or use e-cigarettes anywhere inside the premises. Smoking is permitted only in designated outdoor areas (where applicable). A cleaning charge of £150 will apply if smoking is detected in a room or non-permitted area.
  • Not use the premises for any unlawful purpose, and not behave in a way that causes nuisance, distress, danger, or annoyance to staff or other guests.

We reserve the right to refuse service, refuse entry, or require a guest to leave without refund where, acting reasonably, we consider their behaviour unacceptable, dangerous, or in serious breach of these Terms.

11. Children

Children of all ages are welcome. Parents and guardians are responsible for the supervision and behaviour of children at all times.

12. Pets

We welcome dogs in selected rooms by prior arrangement. Dogs must not be left unattended in rooms and must be kept on a lead in public areas. Owners are liable for any damage caused by their pets.

13. Allergies and dietary requirements

Please tell us about any allergies, intolerances, or dietary requirements at the time of booking and again on arrival. While we do everything reasonably possible to accommodate dietary needs, our kitchen handles a wide range of ingredients and we cannot guarantee that any dish is entirely free from allergens or traces of them.

14. Damage, lost property, and items left behind

You are responsible for any loss or damage caused by you or your party to the premises, fixtures, furnishings, equipment, or property of others, beyond reasonable wear and tear. We may charge the cost of repair or replacement to the card used to secure the booking, or invoice you separately.

We will use reasonable efforts to return items left behind by guests, but we are not obliged to do so. Postage and handling charges may apply. Items unclaimed may be donated to charity or disposed of.

15. Our liability

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be limited or excluded by law.

Subject to that, our total liability to you in connection with a booking, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the total price paid by you for that booking.

We are not liable for indirect or consequential losses, loss of profit, loss of enjoyment, or loss of business.

We are not responsible for the loss of, theft of, or damage to personal belongings brought onto the premises, except to the extent required by the Hotel Proprietors Act 1956 where applicable. Valuables should be kept secure at all times.

16. Events outside our control (Force Majeure)

We will not be liable for any failure to perform, or delay in performing, our obligations under these Terms where caused by events outside our reasonable control, including but not limited to: severe weather, flood, fire, power or utility failure, illness or epidemic, government action, civil unrest, strikes, acts of terrorism, or interruption of transport networks.

17. Complaints

We aim to make every visit a pleasure. If something is not right, please tell a member of our team straight away so that we have the opportunity to put it right while you are with us. Complaints not raised at the time are difficult for us to investigate fairly afterwards.

If you remain unhappy after your visit, please write to us or to our address with full details, and we will investigate and respond as quickly as we can.

18. Data protection

We process personal information in accordance with our Privacy Policy and Cookie Policy, both of which are available on our website.

19. Gift vouchers

Gift vouchers are non-refundable, and cannot be exchanged for cash. They may be used in part payment, but no change will be given. Any unused balance after the expiry date is forfeited. Vouchers must be presented at the time of booking and again on arrival.

20. Third party rights

No one other than you and us has any rights to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

21. Changes to these Terms

We may update these Terms from time to time. The version that applies to your booking is the version in force at the time the booking was confirmed.

22. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that if you live in Scotland or Northern Ireland, you may bring proceedings in your local courts.
